Marvel Cinematic Universe: Phase One Collection Delay

While The Avengers2D and 3D releases are still scheduled to storm Blu-ray on September 25, 2012, Disney has officially delayed the release of the 10-disc Marvel Cinematic Universe: Phase One - Avengers Assembled Collection box set.
Disney issued the following statement:
"We are sorry to inform you that there will be a delay in the availability of the Marvel Cinematic Universe: Phase One – Avengers Assembled Collection. Originally, the Collection was to be available on September 25, 2012, but unfortunately we are now unable to make that date. We are currently working with Marvel to identify the exact date when the Collection will be available, but we expect it to be during Spring, 2013."
However, Disney also revealed that the Collection will now come with new packaging and additional special features:
"The Collection will come in a new briefcase and include even more than the content and features that were first advertised. We know that you are disappointed in this delay, and we are working hard to get your Collection to you as soon as possible. We will have an updated announcement for you in the coming weeks which will include actual timing and final details. Once again, we apologize for the delay and hope that when you do receive the Marvel Cinematic Universe: Phase One – Avengers Assembled Collection, you will enjoy it as much as Marvel enjoyed creating it."
No further details have been provided about the new briefcase design or packaging, or the additional content and features Disney mentions in its press release.
Also, while Disney didn't reference any particular cause for the delay, the culprit is presumably the lawsuit recently filed in California by German luggage manufacturer Rimowa, the company that designed the briefcase that appears in the film and upon which the Phase One briefcase was based. Marvel reportedly had the right to feature the briefcase in the film but not as a part of a mass-produced collectible. Rimowa's complaint stated that the replica case is "a close copy of Rimowa's Topas attaché case in every respect but quality -- from the proportions and coloring, to the style of the handle and latches, and, of course, in the use of the trademarked parallel ridges around the body of the case."
Well, I know more than a few collectors who'll be storming the gates over the delay of receiving their steel briefcases. I'm not one of them, but my heart goes out to you. There's not much I grab in regards to special packaging, but when I do, I always look forward to it like it's Christmas morning.
I imagine this has to do with the lawsuit from the manufacturers of the briefcase featured in the film. Apparently they had permission to use it in the film but not as part of the Blu-ray release.
Well, I'm still getting the 2-Disc Blu-ray/DVD Combo Pack for "The Avengers" when it comes out. Don't need the set since I have all the other post-Avenger movies. I'm still waiting for "The Dark Knight Rises" to be announced.
@dsman71 if someone used your idea or something you created with out getting permission from you and made a lot of money from it wouldn't you get ticked off too. As much money as Disney/marvel makes they should know better.
Its a briefcase ! How many briefcases are there in the world ? Blade Runner had a briefcase, business people use a briefcase. While we are at it, lets start lawsuits over blu ray case designs , eco cases , digibook designs , steelbooks.
I'm still waiting for "Hamburger: The Movie" to come out on BD in Special Collector's Edition in Big Fully Loaded Cheeseburger collectible packaging, but rumors are that Burker King was sueing because it resembled the Double Whopper w/Cheese.
Please, gimme a break....so there's a briefcase in the film and Disney/MARVEL wants to do a special briefcase packaging and someone has a problem with it?
Sorry, but this is as stupid as someone claiming that the new Red Dawn film looked like a recruitment film for the Army. That's like saying The Avengers was a recruitment film for S.H.I.E.L.D.
The briefcase they used was a specific briefcase design from that company. They required specific rights in order to use that briefcase in the movie. They did not obtain the rights to make replicas. It's pretty clear cut.
To me, Rimowa is within their rights to sue. The fact they couldn't come to an agreement bums me out since I've had this set preordered for months. And the fact that the legal powerhouses at Disney didn't see this coming is mindboggling to me as quick as they are to sue if even a hint of Mickey shows up anywhere other than authorized materials.
Hm, when its true that there will be more bonus features than right now... then I will thinking about to get the briefcase. :-)
But when I buy a blu-ray, then I don't need the DVD's which are included (I never use/need it) and also not interested on the Digital-copies/ultraviolet things. Common, when i'm watching a movie then I do it onto a big plasma/LCD 42" TV and not on portable media or computer.
If they're delaying to redesign the briefcase, then the briefcase needs to be the Starktech briefcase from Iron Man 2. All the collectors would nerdgasm.
If the case was metal it would have been cool but it's cheap plastic and the disc are in cardboard sleeves so that another thing I didn't like either .I pass when and if it doesn't come out .

So, I guess they will soon send an e-mail out and cancel all of our orders. I guess it is to be expected if the product will most certainly change, I wonder how the price will be affected because of this whole debacle.
Why delay it until 2013 Marvel? The set was suppose to come out this September. But at least we know it won't be a long delay. Looking forward to it when it comes out. The Avengers is the best marvel comics movie ever. Oh well I will get the Blu-Ray Version of The Avengers (The one without the 3D Version) later this month anyway.
i mean really if no one even own's thor ,captain america all 2 iron man film's then i really i really just dont understand why in the world are u a movie buff,let a lone a person who like to have a collection of bluray's.all of these superhero film's are fantastic in there own little way and before i for get even the incredable hulk on bluray,if u dont own all of those then please right now go out and buy them,and save your money and just buy the avengers on normal bluray or bluray 3D what every your heart goes for .but this to me is just crazy people waitng for a suitcase full of the movies that u can already buy right now.it make's no point of sense.Too me i am fine were i am with owning the film's on normal bluray.
September 2012... to Spring 2013... okayyy... that's almost 6 more months. You better make this wortwhile with loads of behind the scenes and special features... and make it available individually since I own almost all of the titles.
@Youngbus46 Finally someone understands my thoughts.....this was the only essential disc missing in the set. If they put it in, it would make me happy and make the set perfect. I don't care about the 3D versions, I just want all the special features!!!!
Looks like the webmaster got the information wrong on this article news item. ICv2 has been reporting that Marvel violated the copyright and trademark of the briefcase design for this home video release collection:
A lawsuit was filed by German luggage maker Rimowa BhmbH against Marvel/Disney for replicating an untold number of "fake" copies of the briefcase for this home video release without obtaining a license to do so. Marvel had only licensed the briefcase to be used in the movie, where they transported the Cosmic Cube. They did not have a license to mass produce the briefcase for home video distribution.
I think someone needs to update the article up there. lols

Huge bummer! The collector's set was probably the coolest in America in years! It's certainly the coolest looking set I've seen Disney make.
I guess we'll still be stuck with steelbooks and "collector's" editions that only come with little more than big cardboard boxes and a book (a la the Titanic box set).
Well maybe they will have a metal case this time and a better case for the blu rays because those cardboard they had them in would scratch the disc very easy .For me I own all the blu rays anyway so I felt it was a waste of money to begin with .Really all it is was just another Gimmick it seems like that going around today
I mean take a look at Best Buy first they were the only ones that had the Jaws Digibook and now they had the Terminator blu ray box set ...
I only have Walmart were I live and it ticks me off that store can be aloud to do this with all these gimmicks anyway because all people do is have employees who work there buy the item before they come out and then sell them on ebay there should be some sort of law against this
@kemcha - The post is about the official delay, Disney's response, and the promise of new packaging and features. It isn't inaccurate, it just doesn't discuss the lawsuit. (Much like Disney's press release.) Incomplete maybe, but not wrong

Has anyone entertained the idea that they may abandon the briefcase design entirely and find some other method of displaying the cosmic cude? If so, what do you think they could go with?
